We are yet to be INDEPENDENT of Great Britain. I concede to that appellation because they tried and succeeded in imposing their version of civilisation and language on all the colonies they captured with Nobel discovery of GUN POWDER! Natives could not understand nor could they counter the fire power of British mercenaries, explorers and traders. They came, they saw and they took over communities, kingdoms and NATURAL RESOURCES. At a time, the British Navy was the most efficient and dreaded fleet in the entire world and they earned the sobriquet GREAT BRITAIN despite the actual small land mass!

That Queen’s English is AN INTERNATIONAL MEDIUM OF COMMUNICATION to date demands respect and gratitude as you, my LITERATE NATIVE or reader has benefitted most out of their ancient barbaric, military bravado and/or brutish brigandage in the old dispensation of colonial expansion, at least you can understand WRITTEN and SPOKEN ENGLISH! They were great both in criminality and military superiority!

 Today, they occupy the back seat of modern warfare with Nigeria, Ivory Coast, Gambia and all other colonial nations they enslaved who are still PAWNS IN THE CHESS BOARD! Other nations WHO HAVE RENAMED THEIR COUNTRIES have left us dullards to continue depending on the cunning Britons! A country that still imports military bullets, rifles, grenades, ferrets and other vehicles are not INDEPENDENT OF THE SLAVE MASTERS. The crafty Britons only changed the labels on their FORMER COLONIES but are STILL PULLING ALL THE POLITICAL STRINGS FROM BUCKINGHAM PALACE. SPECIAL APPEAL FOR YOUR INTERVENTION IN OUR PREMATURE AND UNLAWFUL RETIREMENT FROM SERVICES OF THE ENUGU STATE COLLEGE OF EDUCATION (TECHNICAL) ENUGU
It is in view of the oversight functions over education matters in Enugu State, which your Committee exercises on behalf the Honourable House of Assembly,that we are constrained to place this special appeal before you for your intervention.
By letters titled “Notice of Retirement” and dated 30th March, 2017 (APX i), served on us recently by the ESCET Management, we were prematurely and unlawfully retired based on the abrogated 35 years Public Service Rule, contrary to the extant 65 years of service that applies to academic staff of tertiary institutions. If this retirement exercise by Management is allowed to subsist we would have been treated as if we were teachers in the secondary and primary school systems of which we are not. Moreover, it will promote lawlessness; injustice; and the rape of the tenets upon which democratic principles are anchored. Please use your good offices to right the wrongs associated with that retirement, and the attendant consequences as the major reason for this special appeal to you.

 B.  Our Journey from IMT TO ESCET
1.  We, the above 5 listed staff were formerly permanent academic staff of the then School of Science, Vocational Teacher Education (SSVTE) IMT Enugu (APX ii). We served IMT for several years before the former Governor of Enugu State, His Excellency, Dr. Chimaroke Nnamani, through his Commissioner for Education Dr. Martin Chukwunweike, ordered all SSVTE staff to move down and open the new Institution now called Enugu State College of Education (Technical) Enugu. A memo to that effect is attached (APX iii). On receipt of that directive we obediently moved down to open ESCET.
2. As Academic Staff of ESCET From IMT
At ESCET it is on record that most policies and programmes are patterned in line with the practices at the parent institution - IMT especially in matters relating to academic, administrative and managerial structures on the one hand; and on the other hand, appointments and promotions. All of us listed above contributed immensely as key players towards the development of the College while the above were being applied. It therefore beats our imagination that Management decided to change the rule in the middle of the game, in matter related to our purported retirement, in which we were treated with high degree of indignity and contempt less than the way primary school teachers would have been handled. No reference was ever made to IMT’s policy on retirement which still upholds the 65 years retirement rule for their academic staff; or to  ESCET Conditions of Service ( CSO) pg 58 [APX iv a], and other relevant documents. The stand of the Enugu State Government since 2012 is that ESCET erred in this matter, and as a result directed Management to withdraw that retirement letter as it was based on the abrogated 35 years of service rule [letter dated 15th February, 2012 (APX iv b)]. Dr Mike C. Onyia, the then Registrar signed the letter by which that retirement was withdrawn [24th February, 2012 and (APX v b)]. It therefore stands cancelled. However, to exhume the matter four years after this unlawful, surreptitious, denigrating, callous, and inhuman action has been laid to rest is highly condemnable and should not be allowed in a democratic setting as is currently practiced in Nigeria. We therefore appeal to the House to stand against this anti-democratic and draculan administrative ineptitude reminiscent of military dictatorship.
C.   Enugu State Government’s Intervention on the Matter in 2012
The Honourable Sir,
We wish to further inform you that in 2012, we received letters of retirement signed by the same former Registrar of the College, Dr. Mike Onyia. The letter dated 15th February, 2012 (APX iv b) indicated that we have been retired from the services of Enugu State College of Education (Technical) Enugu basing on the same abrogated 35 years of service, he also backdating the effective dates of retirement by between 1-5 years as they affect us individually. In the said letters he went further to doctor our salary scales downwards to unleash his wickedness on us for no justifiable reasons. The letters of retirement took us by surprise because of the following reasons:
i.              The Registry (Personnel) generated self contradictory data on which we were retired within 6                         working days (APX v.). Kindly note that the data contained dates of retirement based on the abrogated 35 year, as well as 65year extant rules that affect the academic staff.
     ii.            The reason for his choice of the former over and above the extant latter left behind, moral and legitimacy test.
  iii.             None of us had any adverse report in our records to be so treated. We were denied pre-retirement notice as conditionality in retirement matters.
  iv.             The mandatory three month retirement leave was not given to us.
v.            No due process was ever applied-as the matter was not tabled at any statutory fora of which three of us were significant members of some, not even the former Provost Mr. Anthony C. Anih was privy to the retirement exercise. 
D.  Petition Against 2012 Retirement
 Petition against the unlawful action of the Registrar was written to the former Governor, His Excellency, Barr Sullivan I. Chime (EPX v a).The retirement was inconsistent with Records of Registry Personnel (EPX v a 1) and Auditor’s Report on Overstay in Service (EPX v a 2)..Consequent upon this, an inter- ministerial meeting was convened on 24th March, 2012 comprising of the former Attorney-General Commissioner for Justice, Barr Anthony Ani (SAN) and his Education counterpart Prof. Ortuanya Simon (a Professor of Law); with the College represented by the then Chairman of Council, Mrs Cordelia E. Aduma, Provost Mr. A. C. Anih and the Registrar Dr M. C. Onyia in attendance.  It is noteworthy that the Registrar’s letter dated 15th February, 2012 (APX iv) woefully failed the morality, integrity and legitimacy test in that meeting that lasted for about 30 minutes. Sequel to that meeting- the consideration of that retirement a nullity, the action was therefore voided; and  the College was directed to withdraw those Retirement Letters. The memo withdrawing and cancelling the Letters of Retirement, dated 24th February, 2012, was signed by Dr. Onyia himself (APX iv b).
E.  Activities between 2012 and 2016
Following the withdrawal of the Registrar’s Letter of Retirement as directed by Governor Chime’s Administration, we continued performing our official duties, receiving our salaries, allowances, promotions and appointments without let or hindrances from the ESCET Management. For instance Ogbu, Sylvester C. was appointed the Deputy Provost in 2014 (APX via). Again Dr. Alice Mbaezue was appointed the Dean School of Business Education in 2014 (APX vib). She was also appointed the Chairman of ESCET Certificate Verification Committee in 2016 (APX vib); while Ozongwu, A.U., the former Deputy Provost, was appointed the Director of Confucius Classroom in 2015 (APX vic), to name a few.    
a.     The Thunder Bolt of 2016
About four years after Enugu State Government voided our unlawful retirement and laid it to rest, precisely on 15th January, 2016, one Mr. C. N. Amedu of the Audit Dept Enugu State published an Audit Inspection Report of August 2015, in which we were mischievously branded OVERSTAY STAFF as he based his report on the abrogated 35year Public Service Rule. He went further to recommend our paying back to the College a total sum of N101,894,499.24 being the salaries and allowances paid to us since according to him, we were supposed to have retired years back. He based the retirement on 35 years of service (just like Dr. Onyia did), notwithstanding the position of government on the matter. He thereby:
                                  i.            exhibited culpable disregard of government stand on the issue;
                                ii.            feigned ignorance of existing relevant retirement modus operandi;
                             iii.             did not care to invite us to hear us out in matter of such magnitude, while he invited people to explain why they did not retire amount as low as #10,000;
                             iv.             fail to query the custodians of our records why they did not perform their duties if we were actually due for retirement.
     

  b Over-stepping of Bounds
We wish to note that it is unconscionable for the auditor to dabble into legal matter already concluded by two legal luminaries who handled the issue on behalf government. To arrogate to himself the power to interpret the law and to take position that runs contrary to that of government was a situation where subordinate/employee indicted his superordinate/employer.  This act was a gross insubordination that should not only render the report a nullity, but should also attract serious sanctions against the auditor, and Dr Onyia- the former Registrar. It ought to be noted that both his action and inaction gave him out as one writing a script not flowing for within him. The former can be attributed to his use of the same obnoxious 35year rule introduced in the first instance by Dr Mike Onyia who certainly took advantage of the change of administration in the State to represent the matter government had earlier thrown out as inappropriate His presentation of a copious 18th of August 2015 Audit Report in which this matter was not reflected,  apparently, gave him out as one acting on inducement. Therefore the 15/01/15 is certainly an after-thought. There were also issues that border on his inaction for example, he decided not to demand or use relevant documents especially ESCET Conditions of Service on retirement of staff. Being a senior staff of the Audit Department he cannot claim ignorance that academic staff retire at 65 years since all retirees’ records from IMT pass through the State Audit. We therefore challenge Mr. C. N. Amedu to come up with names of academic staff of the same IMT Enugu who were born between 1947 and 1957 who were retired based on 35years of service with effect from 2008 and were charged to refund certain amounts of money. The foregoing evidences are weighty enough in establishing a case of surreptitiousness, intrigue and injustice in this matter. He did not also demand why the Registry failed to follow due process on the matter Therefore, these are substantial enough to render the Audit Inspection Report a nullity and also cast a question mark on his integrity as the public servant.
 F.  Evidences of Injustice and Denials
i.         Special case of Afuba Christopher
Mr. Afuba Christopher was a Chief Instructor in the Dept of Fine and Applied Art Education. He was a pioneer staff of FAAE in 2006. In 2012 he received a 3 month notice of retirement from the Registrar Dr. Mike Onyia. At the expiration of the 3 months he received a letter of retirement based on 65 years of age but due to administrative recklessness and mischievousness of Dr. Onyia and Amedu C.N, Mr. Afuba was listed among the 5 academic staff retired on 35 years of service in 2012. What a double standard! Since 6 years ago he has never received a dime from the College. With the publication of the Audit Inspection Report of 2016 his condition became worse as he was billed to pay N7,607,685.00 back to the College as his retirement was back dated to 2008.
ii.     Detention at the state C.I.D Enugu
On 22/3/17 we, the 5 lecturers were directed by the Management to proceed to the state C.I.D Enugu where 3 of us that reported were detained for 12 hours for alleged participation in the prayer session organized by the non-academic staff. Sincerely speaking none of us took part in that prayer session. We later made statements to the police about the retirement saga. This clear case of injustice and misplaced aggression is humiliating and paints us as criminals which we are not.
About a week after our detention and incarceration at the state C.I.D we received Notice of Retirement from the Management of the College. The document was dated 30th March, 2017 (APX v). It emanated from the Audit Inspection Report of 15th January, 2016 basing our retirement on the same 35 years of service. It directed that we should pay all the monies – salaries and allowances etc paid to us from 2008 to March 30th 2017, back to the College as a result of our “overstay” in service.. We did not overstay in service because of the 65 years age rule for retirement of academic staff. We promptly rejected the Notice of Retirement in writing, since it was premature, unlawful and based on the same abrogated 35 years of service.
iii.   Retirement Comparison
a.     A comparison of that Notice of Retirement issued to us and those issued to our colleagues Mr. Odo Nicholas and Rev. Ezugwu Samuel of IMT Enugu dated 22nd January, 2016 (APX vii) reveal complete disrespect and disregard of the ESCET Management to the established Conditions of Service, Public Service Rules and Acts guiding the retirement of academic staff in Tertiary Institutions in Nigeria. Why did the Management ignore and shy away from stating our ranks as academic staff in the letters of retirement as was the case with our colleagues from IMT Enugu. In addition theirs was based on extant 65 years while ours reflect the use of the abrogated 35 year rule. Same 65 years applied  in 2010 to the following retirees:
b.     Mazi L.O .E Okata – the pioneer Provost of ESCET
c.      Dr. M. O. Mkpozi – the pioneer Deputy Provost of the College
d.    Mr. ACB Onyedinma – a lecturer in the Dept of Technical Education
 
iv.   Implication of Meting out Injustice on the Indigenes of Anambra State
Among the academic staff affected by the unjust retirement are 3 lecturers from Anambra State. The architects of this problem ignored the fact that inflicting injustice on these 3 lecturers can spark off serious conflict between Enugu and Anambra States. This is true in view of the fact that there are many indigenes of Enugu State working in various establishments in Anambra State. A shitch in time saves nine, our people say.
G. Documents that Support Retirement of Academic Staff at 65 years

      Federal Ministry of Education Circular dated 16th June, 2010 (APX xi)
            Retirement Age of Staff of Polytechnics and Colleges of Education (Harmonization)
             Act 2012  (APX, xii)
           Federal Republic of Nigeria official Gazette- Public Service Rule (2008 edition) (APX xiii)
          Letter to the Head of Service on Retirement Age of Staff of Polytechnics and Colleges of     Education (Harmonization) Act 2012 dated 25th April, 2014 by the Attorney General and Commissioner for Justice (APX xiv)
All the above documents stipulate that academic staff in Polytechnics and Colleges of Education retire at 65years of age. This very fact was used on our colleagues who retired in 2010 as staff of SSVTE/ IMT  who moved down along with us to open ESCET in 2006.
Why should our own retirement be different by basing it on the abrogated 35 year service rule?
         
Prayers
The Honourable Chairman Sir, having presented the facts of our unjust retirement, kindly permit us to sincerely pray as follows:
1.     Prevail on the Enugu State Government to set aside and disregard The Audit Inspection Report of 15th January, 2016 because it was a product of conspiracy hatched to siphon and deny us (5 innocent lecturers hooked into the plot) our pensions and gratuity.
2.     Cause the ESCET Governing Council and the Management to recall us back to our duties.
3.     Direct the ESCET Management to pay us our salaries and all entitlements from April to date.
4.     Order the ESCET Management to recall Mr. Ogbu S.C to serve out his tenure as the Deputy Provost of the College. This is in view of the fact that his appointment is a 4 year political appointment which expires in 2018. 
5.     Make the College Management to revert the retirement status of Afuba Christopher from 35 years of service to 65 years of age as an academic staff and pay him his entitlements.
6.     Intervene to cause  ESCET Management to pay Mr. Ozongwu Albert U. all his entitlement as Deputy Provost who completed his tenure, and allowances due to him for the period he was the Acting Provost when the Provost Mr. Anih A.C. was on terminal leave.
Honourable Speaker Sir, we are looking forward to receiving justice in this matter. Thank you.
